
Attorney General Eric Holder has made news, most recently for announcing that Khalid Sheikh Mohammed and several 9/11 conspirators would be put on trial in New York City, more often than any other cabinet member. As I noted last month, this is often to the detriment of his boss. At least in the case of trying in American courts foreign terrorists captured on foreign soil, it is also to the detriment of his country, as Senator Lindsey Graham made so abundantly clear in his devastating questioning of the attorney general.
Those accused of terrorism or aiding and abedding such should have the right to confront their accusers, at least. Just as America's taken prisoner in Red China and the Soviet Bloc should have.
Unlawful enemy combatants are not even covered under the Geneva Convention, never mind subject to the Rights of Americans as defined by our Constitution. So, there should be no trial other than a military tribunal before they are taken out to be shot.
And if it weren't for the fact that the possibility exists to extract information from these human pieces of excrement, they would unceremoniously be shot in the field as they should be.
I didn't say anything about the Bill of Rights. There are conventions we have instituted to specially protect the rights of American citizens, that's true. But keep in mind that the colonists did not only appeal to their rights as Englishman. They appealed to universal rights, that "ALL men are endowed by their Creator with certain unalienable rights..."
In other words, before a government is to deprive ANY person of their life, liberty, property and their freedom to use them in the pursuit of happiness, that person must be given some form of due process.
So, rejoinders such as yours simply beg the question: How do you know they are the human pieces of excrement the State claims they are? That must be proven somewhere. And, btw, that may very well be under a military tribunal or something akin to Nuremburg. The same conventions don't have to apply as would to you and me in a civilian court, but a certain minimal modicum of due process is demanded by our sense of human dignity and justice.
This is a simple matter of justice and application of the Golden Rule: If you were to be plucked off a street somewhere, you should be able to have actual charges presented against you, and you should be allowed to offer a defense for yourself. It doesn't matter where you are; this respect should be accorded you as a human. Same goes for anyone else. Many wrongfully accused have been released, thank God. How many others haven't, despite spending years in a dungeon with no connection to the outside ever being able to confront their accusers and plead their innocence, if they so wish? Tyrants deny this of people; it is reprehensible that Americans would ever think it okay to just make some people disappear.

It appears that Gunny experiences allot of anger and frustration when individuals display an opinion contrary to his. Correct me here. Didn’t KSM already admit at a military tribunal that he was guilty of planning and helping to execute 9/11 as well as WTC 93’ and the actual beheading of Daniel Pearl? (probably the kidnapping of the Lindbergh baby too). Why did they not convict to finish the job? If they had, he would have been executed already and there would be no civilian show trial as it now stands.
And another lie by the Prevaricator in Chief saying before the election that KSM should be tried before a military court but now when he can sooth the anger of his way left constituency having his AG put on a display of how bad our country and the previous administration was. (America: who loves you baby??!)
Due process? Yeah ok. If you wish. But due process befitting the crime and although KSM and his platoon of human excrement do not wear uniforms and do not represent a particular country, their acts of murder were and are done, in their minds, in the name of WAR. Holy WAR, that is.
So I think by those standards a civilian trial, where they are accorded all of the rights of U.S. citizens under OUR Constitution should not be allowed.
KSM is easy. It is the gray cases that are at issue -- including many who may be innocent. I fully grant that the vast majority are big-time guilty; yet my point still holds.
(I find one comment pretty weird here: "But due process befitting the crime..." It should be "due process *especially* the more serious the alleged crime". If you are accused of something heinous, that is when you will most want your due process. Again, Golden Rule and human justice are involved here.)
Moreover, keep in mind that any power you grant to the State, even if it now is somehow miraculously held to only doing the good and right thing, can (and most often will, as history repeatedly attests) be turned against you and used for ill.
So, whose side is our government on these days?
They've degraded the rules of engagement for our military to the point where our troops abroad can only use harsh language and guys are getting killed with no relief in sight; we're going to judge an admitted terrorist enemy combatant murderer in civil court and allow him all of the rights only available and accorded to U.S. citizens and now we are going to prosecute members of our own Navy SEALS for apprehending a known terrorist murderer and, in the process, giving him a bloody lip? WTF is going on in this country!!!
Liberalism and political correctness are destroying this country and putting us all in harms way.
Furthermore, my heart goes out to parents of our fine young soldiers whose kids are in harms way but are being virtually abandoned.
